1. All work performed per this document by the SUPPORTING ORGANIZATIONS is done at no cost to the LANDOWNER.
2. The LANDOWNER grants permission to the SUPPORTING ORGANIZATIONS and their invitees to access the property described above for the purpose of performing the DESCRIPTION OF WORK.
3. LANDOWNER agrees to defend, indemnify and hold harmless the SUPPORTING ORGANIZATIONS, and their officers, employees, contractors, subcontractors, agents, invitees, successors, and assigns (each an “Indemnified Party”) from and against all claims, demands, losses, liabilities, damages, actions, proceedings, expenses and costs (including reasonable attorneys’ fees and costs of suit) of any nature whatsoever arising out of or resulting from the Indemnified Party’s use of the property or from any other activity, work, or thing done, permitted or suffered by the Indemnified Party in, on or about the property, except, in each case, to the extent that any such claims, demands, losses, liabilities, damages, actions, proceedings, expenses and costs are suffered or incurred as a result of the negligence or willful misconduct of the Indemnified Party.
4. It is understood and agreed that the SUPPORTING ORGANIZATIONS have not at any time made and are not now making, and the SUPPORTING ORGANIZATIONS specifically disclaim, any warranties or representations of any kind or character, express or implied, with respect to the activities identified in the DESCRIPTION OF WORK.
These terms and conditions are thus understood and agreed upon by all parties. Once signed by the Landowner, the activities in DESCRIPTION OF WORK will proceed.
